As you know, the Small Estate Affidavit procedures were recently modified to extend the process to pourover wills without regard to the value of the estate. That extension triggered the name change to Simple Estate Affidavits. But “simple” is very misleading, as there is nothing really simple about this process, and unexpected complications arise all the time.

The CLE will cover the unexpected complications that arise with pourover wills, as well as the following topics:

  • Eligibility Criteria and Requirements
  • Filing Procedures (including forms) and Documentation
  • Handling claims
  • Selling assets
  • Other complications that arise, with practical solutions
  • Upcoming legislative changes

Our presenters are highly experienced attorneys who each have played a significant role in the drafting of the Simple Estate statutes.

Warren Deras graduated from Yale Law School and was admitted to the Oregon State Bar in 1971. After earlier work writing tax and election laws, he became active in writing probate legislation in 1988 and served as legislative chair for the Estate Planning and Administration Section. Warren retired in 2011. After he posted his farewell on the Section’s listserv, the Section Executive Committee made him a lifetime member to encourage his continued participation, and he remains a regular listserv poster.

John Draneas was admitted to the Oregon Bar in 1977 after graduating from Willamette Law School. With both an MBA and CPA designation, he has always practiced in the tax and estate arena. John is currently a member of the Section’s Executive Committee, and chairs the CLE Subcommittee. He recently served on the Oregon Law Commission’s Probate Modernization Committee, which revised the entire probate code, including the small estate provisions. John is also a regular listserv poster.

This seminar is free for Estate Planning Section members but registration is required.

The seminar is not available to non-Estate Planning Section members.
